Terms of Service

These Terms of Service ("Terms") govern your use of the GoBeFish mobile application, website, and related services provided by GoBeFish LLC ("GoBeFish," "we," "us," or "our").

1. ACCEPTANCE OF THESE TERMS

By creating a GoBeFish account, accessing the service, or selecting the in-app agreement control, you agree to the version of these Terms shown to you. GoBeFish records the document version, effective date, action, and server timestamp associated with acceptance. If you do not agree, do not create or use a GoBeFish account.

2. ELIGIBILITY

You must be legally capable of entering into these Terms. GoBeFish is not directed to children under 13. If you are under the age of majority where you live, use GoBeFish only with the involvement and permission of a parent or legal guardian.

3. THE SERVICE

GoBeFish provides fishing-oriented information and decision support, including fishing-condition summaries, lure and presentation suggestions, suggested and alternate color guidance, location-based fishing-area analysis, tackle-aware alternatives, fishing session tools, catch logging, trip history, and pattern insights. Features may change as the service develops.

4. FISHING RECOMMENDATIONS ARE INFORMATIONAL

GoBeFish recommendations are estimates and suggestions based on available inputs, models, rules, environmental data, user-provided information, and third-party services. Fishing conditions can change rapidly, and no recommendation guarantees a catch, a safe condition, legal access, or an accurate description of the water.

You are responsible for your own fishing decisions, including lure selection, equipment, fish handling, boating or paddling decisions, and whether to enter or remain in any area.

5. SAFETY; NOT A NAVIGATION SERVICE

GoBeFish is not a marine navigation, emergency, rescue, weather-warning, depth-chart, property-boundary, or legal-access service. Do not rely on GoBeFish to navigate a boat or kayak, avoid hazards, determine water depth, identify private property, establish shoreline access, or determine whether an area is safe or lawful to enter.

Before fishing, boating, kayaking, wading, or entering property, independently verify weather and water conditions, legal access, property boundaries, boating and fishing regulations, required licenses, closures, hazards, and safe routes. Follow applicable laws and use appropriate safety equipment.

6. WEATHER, MAP, AND THIRD-PARTY INFORMATION

Some GoBeFish features depend on third-party services, including mapping, weather, location, authentication, advertising, consent management, and infrastructure providers. Third-party information may be delayed, incomplete, unavailable, or inaccurate. GoBeFish does not control third-party services and does not guarantee their availability or accuracy.

7. YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. Provide accurate information and promptly protect your account if you believe your credentials have been compromised.

When Apple or Google sign-in is available, your use of those providers is also subject to their applicable terms and policies.

8. ACCOUNT DELETION

You may initiate permanent account deletion from the account area of the GoBeFish app. GoBeFish may require reasonable re-authentication before completing deletion. Account deletion removes the GoBeFish authentication account and associated server-side profile information and clears GoBeFish fishing data stored locally on the device as described in the Privacy Policy.

For legitimate legal recordkeeping purposes, GoBeFish may retain an immutable record that a particular version of the Terms or Privacy Policy was accepted or acknowledged. After account deletion, GoBeFish is designed to remove the account identifier from that retained event record and replace it with a non-identifying audit token. Details are provided in the Privacy Policy.

9. USER DATA AND PRIVACY

Our collection and use of information is described in the GoBeFish Privacy Policy at https://gobefish.com/privacy. The Privacy Policy explains our data practices and does not reduce rights provided by applicable privacy law.

10. LOCAL FISHING DATA

In the current version, fishing sessions, catches, tackle inventory, fishing preferences, saved fishing areas, trip notes, weights, lure or presentation choices, and related fishing history are generally stored locally on the device rather than synchronized to a GoBeFish cloud account. Device loss, app removal, data clearing, or account deletion may result in permanent loss of that local information. Future synchronization features, if added, will be disclosed before use.

11. ADVERTISING

GoBeFish may display advertising. Beta builds may use test advertisements. Advertising and consent services may be provided by third parties such as Google. Advertising availability, format, frequency, and configuration may change. Applicable privacy and consent choices are described in the Privacy Policy.

12. ACCEPTABLE USE

You may not use GoBeFish to violate law; interfere with or damage the service; attempt unauthorized access; misuse third-party services or access tokens; introduce malicious code; impersonate another person; infringe the rights of others; or reverse engineer the service except where applicable law expressly permits that activity.

13. INTELLECTUAL PROPERTY

GoBeFish, its branding, software, interfaces, original graphics, recommendation logic, text, and other original materials are owned by or licensed to GoBeFish LLC and are protected by applicable intellectual-property laws. These Terms provide a limited, revocable, non-exclusive, non-transferable license to use the app for its intended personal use; they do not transfer ownership of GoBeFish intellectual property.

Third-party maps, weather data, libraries, trademarks, and other materials remain subject to their respective licenses and rights.

14. BETA SOFTWARE

Pre-release and beta versions may contain bugs, incomplete features, service interruptions, test data, or behavior that changes without notice. If you participate in testing, you understand that the service is still being evaluated and should not be relied on where failure could create a safety risk or significant loss.

15. CHANGES TO THE SERVICE OR TERMS

We may modify, suspend, or discontinue features. If these Terms materially change, GoBeFish may present a new version for review and acceptance as appropriate. Published legal-document versions and acceptance records are maintained separately so the version presented to a user can be identified.

16. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBEFISH IS PROVIDED "AS IS" AND "AS AVAILABLE." GOBEFISH LLC DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBEFISH LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF DATA, LOSS OF PROFITS, PERSONAL PROPERTY LOSS, OR DAMAGES ARISING FROM RELIANCE ON FISHING, WEATHER, LOCATION, OR MAP INFORMATION.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. INDEMNITY

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of GoBeFish or your violation of these Terms.

19. TERMINATION

You may stop using GoBeFish at any time and may delete your account through the app. We may suspend or terminate access where reasonably necessary to protect the service, enforce these Terms, comply with law, or address misuse.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute that is not resolved informally may be brought in a court of competent jurisdiction in Texas, unless applicable law requires a different forum. These Terms do not require arbitration and do not contain a class-action waiver.

21. SEVERABILITY

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
